1. Talehaven operator
1. The operator of the Talehaven application is:

referred to below as “Talehaven” or the “Operator”.
2. These Terms set out the rules for using the Talehaven application, including creating an account, campaigns, characters, locations, items, maps, documents, files and audio material, as well as publishing and downloading material from the Marketplace.
3. These Terms are available free of charge in a form that allows them to be saved and reproduced.
2. User account
1. Creating an account requires providing the data indicated in the registration form and accepting these Terms.
2. Users should provide accurate data and protect their login credentials.
3. Impersonating other people, companies, publishers, authors or rights holders is prohibited.
4. An account may be created by a person aged 16 or over. A minor should use Talehaven with a guardian's consent where such consent is required.
5. An account is personal and should not be shared with other people.
6. A user may delete their account at any time from within the application or by sending a message to contact@talehaven.app.
3. Scope of services
Talehaven allows users, among other things, to:
1. create and run RPG campaigns,
2. create NPCs, locations, items, maps, documents and other material,
3. upload files, including documents, images, recordings and audio material,
4. share material with other users or campaign participants,
5. publish and download material from the Marketplace,
6. use tools that support running and organising RPG sessions.
Some features may be changed, developed further, temporarily limited or withdrawn.
4. Technical requirements
Using Talehaven requires:
1. a device with internet access,
2. an up-to-date web browser,
3. an active e-mail address, where one is required for registration or account recovery,
4. enabled support for the necessary cookies or similar session storage mechanisms.
The user is responsible for their own device, internet connection and for keeping their own copies of particularly important material.
5. Responsibility for uploaded content
1. The user is responsible for all content and files they create, upload, publish or share through Talehaven.
2. A user may only upload material that is:
a) created by them,
b) in the public domain,
c) covered by a licence permitting its use in Talehaven,
d) used with the rights holder's consent,
e) permitted for such use by applicable law.
3. Purchasing a rulebook, a book, an image, a font, a map, a piece of music, a PDF file or any other material does not automatically grant the right to copy, publish or share it with other people.
4. Crediting the author or the source does not replace a required consent or licence.
5. The user is responsible for complying with licence terms, including restrictions on:
a) commercial use,
b) further sharing,
c) modifying the material,
d) attributing the author,
e) using trade marks,
f) creating and distributing derivative works.
6. This also applies to material connected with specific RPG systems, settings, games, brands, publishers and fan licences.
7. A user may not suggest that their material is an official product, has a publisher's approval, or comes from the owner of a given brand, where that is not true.
8. Material created with AI may only be uploaded where the terms of the tool used allow it and the material does not infringe anyone else's rights.
9. Talehaven may ask a user for information confirming that they hold the appropriate rights or licences. Until the matter is clarified, the material may be temporarily hidden or blocked.
6. Prohibited content
It is prohibited to upload, publish or share content that:
1. breaks the law or infringes the rights of others,
2. infringes copyright, trade mark rights, image rights, privacy or personal rights,
3. contains illegal copies of rulebooks, books, scenarios, images, maps, music, films, fonts, software or other protected material,
4. is pornographic or sexually explicit,
5. depicts the sexualisation, exploitation or harm of minors,
6. incites violence, hatred, discrimination, persecution or the commission of a crime,
7. contains threats, persistent harassment, intimidation, humiliation or the publication of other people's data,
8. contains malware, phishing, spam, fraud or mechanisms designed to circumvent security measures,
9. contains other people's real personal data without an appropriate basis, in particular identity documents, addresses, financial or medical data, or data concerning minors,
10. is misleading as to the author, owner, licence or source of the material,
11. serves to circumvent blocks or restrictions imposed by Talehaven.
Fictional scenes of violence, horror, war and other dark themes typical of RPGs are permitted, provided they do not break the law or the remaining rules of these Terms.
7. Conduct towards other users
1. Users should communicate respectfully.
2. The following are prohibited in particular:
a) threats,
b) persistent abuse and harassment,
c) discrimination,
d) disclosing other people's data,
e) coordinated attacks on other users,
f) spamming,
g) manipulating ratings, downloads or the popularity of material,
h) creating additional accounts in order to circumvent restrictions.
3. A difference of opinion, criticism of material and a negative review do not in themselves breach these Terms.
8. Rights to material
1. The user retains the rights to material they have created.
2. By uploading material to Talehaven, the user grants the Operator a non-exclusive, royalty-free licence solely to the extent needed to operate the service, in particular to:
a) store the material,
b) make technical and backup copies,
c) change the format, compress it and create thumbnails,
d) display the material to the user,
e) share the material with people designated by the user,
f) publish the material in the Marketplace, where the user has chosen that option themselves,
g) ensure security, moderation and the handling of reports.
3. Talehaven does not acquire ownership of the user's material.
4. Talehaven may not sell the user's material or use it in advertising outside the application without separate consent or another appropriate basis.
5. The licence granted to Talehaven expires once the material is deleted, except for:
a) temporary backup copies,
b) data retained in connection with a report, a dispute or a legal obligation,
c) copies previously lawfully downloaded by other Marketplace users.
9. Marketplace
1. By publishing material in the Marketplace, the user confirms that:
a) they hold the rights allowing its publication,
b) they may grant other users an appropriate licence,
c) the description of the material, its authorship and the licence information are true.
2. The user selects a licence available at the time of publication. This may be, among others, a chosen Creative Commons licence or the Talehaven Standard Licence.
3. Where the user selects the Talehaven Standard Licence, the person downloading the material may:
a) save the material to their account,
b) use it during their own RPG sessions,
c) share it with the participants of their campaign within Talehaven,
d) modify it for the purposes of their own campaign.
4. The Talehaven Standard Licence does not permit:
a) selling the material,
b) republishing the material as one's own,
c) distributing it publicly beyond one's own campaign,
d) granting sub-licences,
e) removing the author's attribution,
f) using the material to train AI models.
5. Removing material from the Marketplace stops it from being downloaded further.
6. Removing material does not automatically delete copies that were previously lawfully downloaded or assigned to other users' accounts.
7. Where material has been removed because it breaks the law or because the author did not hold the rights, Talehaven may also restrict access to previously downloaded copies, where this is technically possible and justified by the nature of the infringement.
10. Moderation and reporting content
1. Talehaven does not manually review every file before it is uploaded.
2. Talehaven may use technical safeguards that detect, among other things, viruses, spam, unsafe files and repeated abuse.
3. Unlawful content or breaches of these Terms can be reported:
a) using the “Report” button available next to the material,
b) by e-mail to contact@talehaven.app.
4. A report should include:
a) the link, name or identifier of the material,
b) a description of the infringement,
c) an explanation of why the material is unlawful or breaches these Terms,
d) any available evidence,
e) the reporter's contact details,
f) a statement that the report is made in good faith.
5. Talehaven handles reports in a timely, objective and proportionate manner as far as possible.
6. Depending on the situation, Talehaven may:
a) leave the material unchanged,
b) request additional information,
c) restrict the visibility of the material,
d) block it from being downloaded,
e) remove the material,
f) restrict account features,
g) temporarily suspend the account,
h) permanently delete the account.
7. Talehaven may act immediately where material may cause serious danger, infringes the rights of a child, contains malware, or where sharing it further could cause significant harm.
8. The user will be informed of any restriction, its reason and the possibility of appeal, unless providing such information is prohibited by law or could endanger another person's safety.
9. A decision may be appealed within 6 months by sending a message to contact@talehaven.app.
10. Talehaven may suspend the ability to submit reports for anyone who repeatedly and knowingly submits manifestly unfounded reports.
11. Blocking and deleting accounts
Talehaven may restrict, suspend or delete an account in the event of:
1. serious or repeated breaches of these Terms,
2. publication of illegal material,
3. impersonating other people or companies,
4. a threat to the security of Talehaven or its users,
5. attempted fraud,
6. circumventing earlier blocks,
7. failure to respond to a justified request to remedy an infringement.
Where the situation does not require an immediate response, Talehaven may warn the user first and give them the opportunity to remedy the infringement.
12. Availability and liability
1. Talehaven makes reasonable efforts to keep the application working correctly and safely.
2. The application may be temporarily unavailable due to maintenance, updates, failures or events beyond the Operator's control.
3. Users should keep their own copies of particularly important material.
4. The Operator is responsible for the operation of Talehaven in accordance with applicable law.
5. The Operator is not responsible for content created by a user, nor for the way a user makes use of someone else's material, subject to the Operator's obligations under the law once informed of a possible infringement.
6. These Terms do not exclude consumer rights that cannot be limited by contract.
13. Complaints
1. Complaints about how Talehaven operates can be sent to contact@talehaven.app.
2. A complaint should include a description of the problem, details identifying the account and the expected resolution.
3. Complaints will be handled without undue delay, usually no later than within 14 days.
14. Changes to these Terms
1. These Terms may be amended because of:
a) changes in the law,
b) the introduction of new features,
c) technical changes,
d) changes to security or moderation rules,
e) the introduction of paid services.
2. Users will be informed of material changes in the application or by e-mail.
3. Changes do not affect rights acquired before they take effect.
15. Final provisions
1. These Terms are governed by Polish law, without prejudice to consumer rights arising from mandatory provisions.
2. Disputes will be resolved by the court having jurisdiction under applicable law.
3. If any provision of these Terms proves invalid, the remaining provisions stay in force.
